Payment Schedule
Upon signing this agreement, the security deposit is immediately due. The security deposit will be applied to the balance due for the trip in the event of no incidents or claims with the vehicle for your trip, or held to apply towards the cost of resolution and applicable fees in the even of a claim or incident.
• For trips less than 1 week, the remaining balance will be charged at the beginning of the trip.
• For trips longer than 1 week, the remaining balance will be divided amongst the remainder of
the trip in 1 week increments and each payment will be due every 7 days from the start of the trip.
Incidentals
If you disregard Angera Rentals’ guidelines or violate policies, you may be charged a penalty fee. If you cancel a trip outside of the free cancellation period or fail to show up for a booked trip, Angera Rentals will charge you a cancellation fee of . • Additional distance fee: Any mileage on the vehicle in excess of the mileage limitation will be
subject to an excess mileage surcharge of $.15 per mile.
• Claims processing fee: If you return the vehicle damaged, a claim will be filed, and Angera
Rentals will charge you a claims processing fee. Up to $50 for minor (<$500), $100 for moderate (<$1500), and $150 for severe vehicle damage.
• Cleaning violation fee: If you return the car in a condition that could have only resulted from
irresponsible or abusive behavior, we may charge you a violation fee of $150.
• EV recharginging convenience fee: Electric vehicles are to be returned with at least the lesser
of the charge level upon delivery or 80%. Failure to do so will result in a $20 convenience fee
in addition to $10 for every 30% less than the required state of charge.
• Gas refueling convenience fee: Gas vehicles are to be returned with at least as much fuel as
when delivered. Failure to do so will result in a $20 convenience fee in addition to the cost to
replace the gas.
• Late cancellation fee: If you cancel your trip 24 hours before until trip start, you will be
charged 50% of 1 day at your daily trip rate. After, any cancellation is billable from trip start
through the day of the cancellation.
• No show fee: In additional to any applicable late cancellation fees, no shows without
cancellation or notification up to 4 hours after the trip start is subject to a $50 no show fee
and 50% of any associated delivery fee.
• Improper return fee: Angera Rentals may charge you a $100 improper return fee if you fail to
respond to requests to return a vehicle, abandon a vehicle, or do not follow vehicle return
instructions, in addition to any expenses incurred because of the improper return.
• Late return fee: If you return a vehicle 2 hours or more past the trip’s scheduled end time
without confirmed agreement for extension, a $25 late return fee could be charged, in
addition to extra days charged at the booking daily rate for every 24-hour period beyond the
trip end the car is kept.
• Pet policy violation: If you either transport a pet in a vehicle where pets are not approved, or
failure to notify and pay the required pet fee for the trip in approved vehicles, will result in a
$200 pet policy violation fee.
• No smoking policy violation: Neither you nor your passengers may smoke in any Angera
Rentals vehicle. Doing so will result in a $250 smoking violation fee.
Insurance
Renter must provide to Owner with proof of insurance that would cover damage to the Rental Vehicle at the time this Car Rental Agreement is signed, as well as personal injury to the Renter, passengers in the Rented Vehicle, and other persons or property.
If the Rental Vehicle is damaged or destroyed while it is in the possession of Renter, Renter agrees to pay any required deductible (up to $3000 if their insurance does not cover), and also assign all rights to collect insurance proceeds to Owner. This includes but is not limited to administrative processing fees, repair costs, diminished value in vehicle, loss of rental income, towing & storage, and any fees incurred as a result of processing the damage claim or handling the damaged vehicle.
Indemnification
Renter agrees to indemnify, defend, and hold harmless the Owner for any loss, damage, or legal actions against the Owner as a result of Renter’s operation or use of the Rented Vehicle during the term of this Car Rental Agreement. This includes any attorney fees necessarily incurred for these
purposes.
Renter will also pay for any parking tickets, tolls, moving violations, or other citations received while in possession of the Rented Vehicle.
Representations and Warranties
Owner represents and warrants that to Owner’s knowledge, the Rental Vehicle is in good condition
and is safe for ordinary operation of the vehicle.
Renter represents and warrants that Renter is legally entitled to operate a motor vehicle under the
laws of this jurisdiction and will not operate it in violation of any laws, or in any negligent or illegal
manners.
Renter has been given an opportunity to examine the Rental Vehicle in advance of taking possession
of it, and upon such inspection, is not aware of any damage existing on the vehicle other than that
notated by separate Existing Damage document.
Jurisdiction and Venue
In the event of any dispute over this agreement, this Car Rental Agreement will be interpreted by
the laws of Alameda County – CA USA, and any lawsuit or arbitration must be brought in the corresponding region of Alameda County – CA USA.
If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.
